Consultation on changes to Terminal Code

Results of consultations - draft dated 25.04.2022.


As a result of consultations on the draft Terminal Instructions, which lasted from 26.04.2022 to 26.05.2022, and in accordance with the Energy Law, Gas Transmission Operator GAZ-SYSTEM S.A. (hereinafter referred to as GAZ-SYSTEM), the owner and operator of the President Lech Kaczynski LNG Terminal, developed a draft instruction for the operation and use of the liquefied natural gas facility under the name "Terminal Instruction dated 25.04.2022" and subsequently submitted the instruction to the President of the Energy Regulatory Authority for approval.

As part of the consultation process carried out, an opportunity was created for all interested parties to review the draft Terminal Instruction and submit comments on it.

All comments submitted to the draft Terminal Instructions were analyzed in detail with regard to the proposed amendments to this draft.

In view of the above, GAZ-SYSTEM hereby publishes the Terminal Instructions (draft instructions for operation and use of the liquefied natural gas facility submitted for approval to the President of the Energy Regulatory Office) together with information on the comments submitted and the manner in which they have been taken into account:

Consultations on the Draft Instructions for Operation and Maintenance of the Liquefied Natural Gas Facility

Gas Transmission Operator GAZ-SYSTEM S.A., owner and operator of the President Lech Kaczyński LNG Terminal, invites all interested parties to participate in consultations on the draft Terminal Instructions.

In accordance with the Energy Law, the Terminal Operator has developed a draft of the Terminal Instructions, which, as draft instructions for operation and use of the LNG facility, will be submitted for approval to the Chairman of the Energy Regulatory Office. In connection with the above, GAZ-SYSTEM S.A. is announcing public access to this draft and the opportunity to submit comments.

As a result of the above, GAZ-SYSTEM S.A. plans to amend the current Terminal Instructions in accordance with the update sheet below:

Reasons for changes
In connection with the obligations set forth in the Energy Law, GAZ-SYSTEM S.A. as the Terminal Operator has developed a draft of the new Terminal Instructions, which it intends to submit to the President of the Energy Regulatory Office for approval as a draft of the LNG Facility Operation and Maintenance Instructions. Once approved, the new Terminal Instructions will apply to all current and potential new Terminal Users.

Scope and content of the changes

In place of:
Terminal Instructions dated 31.10.2009, and
Terminal Instructions dated March 23, 2020, and
Terminal Instructions dated 02.12.2021,
new Terminal Instructions will be applied, uniform for all agreements with Terminal Users and for all potential new Terminal Users.

Upon approval of the new Terminal Instructions by the President of the Energy Regulatory Office, the previous Terminal Instructions will no longer be in effect as of the effective date of the new Terminal Instructions.

Planned effective date: Upon approval by the President of the Energy Regulatory Authority.

In accordance with the above update sheet, GAZ-SYSTEM S.A. is submitting for consultation the following draft of the LNG Facility Instructions: "Terminal Instructions - draft dated 25.04.2022".

We invite all interested parties to familiarize themselves with the subject draft of the Terminal Instruction.

Consultation results - draft as of March 31, 2022.

As a result of consultations on the draft Terminal Instructions, which have been ongoing since November 2021, and in accordance with Article 17(3) of the Act of May 20, 2021 on amending the Energy Law and certain other acts, the Gas Transmission Operator GAZ-SYSTEM S.A. (hereinafter referred to as GAZ-SYSTEM), the owner and operator of the President Lech Kaczynski LNG Terminal, developed a draft instruction for the operation and use of the liquefied natural gas facility called "Terminal Instruction Draft as of March 31, 2022," and then submitted the instruction to the President of the Energy Regulatory Authority for approval on April 1, 2022.

As part of the consultation process carried out, an opportunity was created for system users to review the draft Terminal Instruction and submit comments on it, as well as for external entities without such status.

All comments on the draft Terminal Instruction submitted throughout the consultation process were analyzed in detail in terms of the proposed amendments to the draft Terminal Instruction, with a number of proposals and comments incorporated into the content of the Terminal Instruction.

Consultations on amendments to Terminal Code – second round - March 08, 2022

Reasons for amendment

GAZ-SYSTEM as the Terminal Operator intends to introduce for application a uniform Terminal Code for all contracts concluded with Terminal Users, containing uniform rules for all potential new Terminal Users, and present it for approval by the President of the Energy Regulatory Office.

Scope and content of the amendments

 

Instead of:

  • Terminal Code dated 31.10.2009, and
  • Terminal Code dated 23.03.2020, and
  • Terminal Code dated 02.12.2021.

The new Terminal Code will apply equally to all contracts with Terminal Users and to all potential new Terminal Users.

Upon approval of the new Terminal Code by the President of the Energy Regulatory Office, as of the effective date of the new Terminal Code, the previous Terminal Codes will go out of force.

Planned effective date: Following the approval by the President of the Energy Regulatory Office.
 

In accordance with the above revision sheet, GAZ-SYSTEM submits the following draft document for consultation with market participants: “Terminal Code - draft dated 08.03.2022”.

  • All interested market participants, including Terminal Users, are invited to submit comments on the draft Terminal Code by 25 March 2022, 17:00 (CET).
  • The comments referring to the Terminal Code should be sent by email to kancelaria.warszawa@gaz-system.pl
  • GAZ-SYSTEM will review the submitted comments and prepare the final Terminal Code.
  • GAZ-SYSTEM reserves the right to amend or supplement the draft Terminal Code and to extend the consultation period, if necessary. Such changes and additions will be announced on the GAZ-SYSTEM's website.

Documents

The draft Terminal Code offered for consultation is preliminary and is subject to further consultations. Changes to the draft Terminal Code will be introduced based on the information obtained during these consultations and as a result of further work on the draft Terminal Code carried out by GAZ-SYSTEM.

GAZ-SYSTEM undertakes to review all information obtained during the consultations with due care, but reserves the right to take into account some of the information and omit other information in further work on the Terminal Code at its own discretion.

Consultations on amendments to Terminal Code–first round, November 10, 2021

Gas Transmission Operator GAZ-SYSTEM S.A. (hereafter GAZ-SYSTEM), the owner and operator of the President Lech Kaczyński LNG Terminal, is planning to amend the Terminal Code.

GAZ-SYSTEM plans to introduce changes in accordance with the revision sheet below:

Reasons for amendment The Terminal Code of 2009 which is currently in force is applicable to currently performed Regasification Contracts. The goal of the 2020 Open Season Procedure for the LNG Terminal was to conclude Regasification Contracts that would be subject to the new 2020 Terminal Code. The new Code should enter into force in 2022 and be binding for the Regasification Contracts concluded under the Procedure. In view of the approaching completion of the first stage of the expansion of the President Lech Kaczyński LNG Terminal and in order to optimize capacity utilisation of the Terminal, GAZ-SYSTEM as the Terminal Operator intends to introduce uniform Terminal Code applicable to all contracts
Scope and content of the amendments Instead of:
  • Terminal Code dated 31.10.2009,
  • and the Terminal Code dated 23.03.2020
New Terminal Code will be introduced and apply in a uniform manner to all contracts with Terminal Users and to all potential new Terminal Users.
The previous Terminal Code will go out of force as of the effective date of the new Terminal Code.
